Failure 1: data residency unknown
Data residency is the most common and most preventable failure mode.
The CISO's question is simple: when a user interacts with this AI feature, where does their data go? The expected answer is a specific list of servers, geographic regions, and data processing entities — not "to the AI API" or "to our vendor's servers."
Most AI feature proposals arrive at CISO review without this answer. The engineering team knows the app calls an API. They may not know which data centers that API uses, whether data is replicated across regions, or whether a subprocessor in another country handles parts of the inference.
For regulated industries, data residency is not a preference — it is a compliance requirement. Healthcare data under HIPAA must be processed by entities with a BAA. Financial data under applicable state and federal regulations may be restricted from certain jurisdictions. Government and defence applications may require data to stay within US infrastructure.
How to clear this failure mode before CISO review: document the full data flow. Start from the point the user input leaves the device and trace it to every server it touches and every entity that processes it. Map each processing entity to a geography. Identify which entities require contractual agreements (BAA, DPA, SCCs for non-US processing).
If that documentation reveals that the data flow is not acceptable for the regulated use case, address it before CISO review — either by negotiating the appropriate vendor agreements or by redesigning the feature to use on-device AI, which eliminates the data flow entirely.
Failure 2: vendor terms not reviewed
The CISO review process includes a third-party vendor risk assessment. For AI features, this assessment focuses on the AI vendor's data processing terms: what they retain, how long, what they use it for, and what rights the enterprise has to request deletion.
Most AI feature proposals arrive at CISO review citing the vendor's name — "we're using OpenAI" or "we're using AWS Transcribe" — without a legal review of the vendor's current terms. The CISO's security or legal team then needs to obtain the terms, review them, and assess whether they are acceptable. This review takes weeks.
For standard cloud AI vendors, terms include provisions that most CISOs need to assess carefully: default data retention periods, opt-in or opt-out status for model training use, the conditions under which employees of the vendor can access inputs, and the process for requesting deletion.
How to clear this failure mode before CISO review: obtain the vendor's current data processing agreement before the CISO review meeting. Identify the provisions that are most likely to require negotiation: retention period, training use, human access to inputs, and jurisdiction for dispute resolution. If your organisation requires a BAA, initiate that conversation with the vendor before the CISO review — having the BAA in progress signals that the compliance work is being done, not deferred.
If the vendor's standard terms are not acceptable and negotiation is not feasible within the project timeline, redesign the feature to use on-device AI. There is no vendor to negotiate with when the model runs on the device.
Failure 3: user consent flow absent
AI features that process sensitive user data require explicit user consent that is specific to the AI processing — not reliance on the app's general privacy policy.
The consent disclosure for a cloud AI feature must tell users: what data is processed by the AI, where it goes (that it leaves the device and goes to a named third party), how long the vendor retains it, and what it is used for. It must give users a way to decline.
Most mobile app privacy policies include general language about data sharing with service providers that was not written with AI inference in mind. A privacy policy that says "we share data with third-party service providers" does not satisfy CISO review for an AI feature that sends sensitive user inputs to an external inference server on every interaction.
How to clear this failure mode before CISO review: write the AI-specific consent disclosure before build. Define what users will be told about the feature, where their data goes, and what their options are. Have the CISO or legal team review the disclosure language before engineering begins. This is a one-page document that takes a day to produce and prevents a 6-month delay.
For on-device AI, the consent flow is simpler: the disclosure is that AI processing happens on the user's device and data does not leave it. This typically satisfies CISO consent requirements without negotiation.

In regulated industries, AI-assisted decisions must be auditable. A clinician who used an AI feature to assist with documentation must be able to retrieve a record of that interaction in the event of a compliance review. A financial services firm whose AI feature assisted with investment recommendations must have a log that shows what the AI processed, when, and what output it produced.
Most mobile AI features are built without an audit logging component. The feature works — it processes user input and returns AI output — but there is no record of individual interactions that can be retrieved in a compliance context.
How to clear this failure mode before CISO review: define the audit logging requirement before engineering begins. Specify what events must be logged (AI feature invocations, inputs processed, outputs produced), where the log is stored (on-device only, or synced to enterprise infrastructure), how long it is retained, and who can access it. Then build the logging into the feature from the start rather than adding it after CISO rejection.
The audit log does not need to store the full AI input and output. It needs to record that a specific user invoked the AI feature at a specific time, processing a specific category of data. The specifics of what was logged depend on the regulatory requirements of the industry — get the CISO's team to specify the minimum log requirements before build.
Failure 5: third-party SDK audit incomplete
Mobile apps typically include multiple third-party SDKs. Analytics SDKs. Crash reporting. Attribution tracking. Push notification services. Each SDK may transmit data to its own servers. The CISO needs to know what all of them are doing.
For AI features, the SDK audit concern is two-fold: the AI inference SDK itself (what data it transmits, if any) and the other SDKs in the app that might co-process data alongside the AI feature.

How to clear this failure mode before CISO review: conduct a full SDK inventory. List every SDK in the app, its version, its data collection and transmission behaviour (documented from the SDK's privacy documentation), and the contractual relationship in place with the SDK provider. This is a one-time exercise that updates with each SDK addition.
